Refer a Friend Terms
Our Refer a Friend Program (the “Program”) allows eligible Boring customers both to give their friends and family the opportunity to receive a $50 discount on Boring mattresses, and to receive $50 for each of their purchases.
These terms and conditions apply to the Program. By referring a friend or family member who meet’s Boring’s requirements, or otherwise participating in the Program, you agree to be bound by these terms and conditions (the “Program Policy”), as well as the Boring Terms of Use and Privacy Policy. In the event of any conflict or discrepancy between this Policy and the Boring Terms of Use and/or Privacy Policy, the Terms of Use and/or Privacy Policy shall govern. Please review these terms carefully, and often. We may change, suspend, extend or end the Program or these terms at our discretion at any time without notice. A person who refers friends / invites them to make purchases under the Program is a “Referrer.” A person who receives an invitation to participate is a “Referee.” A completed purchase of a new Boring mattress under the Program by a Referree, which mattress is kept for 99 or more nights, is called a “Referral.” An incentive benefit provided by Boring under the Program is an “Award.”
1. Eligibility: To participate in the Program, you must be a natural person and of the age of majority in the state/province or jurisdiction where you are resident at the time of participation. The Program is void where prohibited by law. The Program, its benefits, and its Awards cannot be combined with any other promotions and are not valid for previous offers, purchases or orders.
2. Program Access & Termination: Access to the Program is provided exclusively via a dedicated link on the official Boring webpage; Internet access is required to participate. The Program is only available to existing Boring customers who refer a new friend or family who do not yet own a Boring mattress. We may modify or cancel your participation or the entire Program at our discretion. Use of fake accounts, a breach of this Policy or the Terms of Service, abusing the Program, or manipulating it through technical means may lead to cancellation, removal and legal action. Referrers may not self-refer themselves, or create multiple, fictitious or fake accounts, or otherwise participate in the Program as a “Referees”. No user may use the Program to violate or assist in the violation of any law, infringe or violate or assist in the violation of the rights of any third party, or otherwise act in a manner that is deemed harassing, harmful, illegal, hateful, distasteful, unethical, indecent, obscene or outside the spirit and intent of the Program. In addition, you may not tamper with the Program, act in an unfair or disruptive manner, or use any system, bot or other device or artifice to participate or receive any benefit in the Program. Boring reserves the right to not award, to void, and/or to rescind any Award based on ineligibility of any Program participant, or if Boring, in our sole discretion, feels that you have violated the Policy or any of our other Terms and Conditions.
3. Referral Limits: You may refer exclusively to your known family, friends, and acquaintances. Referrers and Referees may not share the same full legal name, email account, shipping address, billing address, or IP address. Publishing or otherwise distributing a unique referral code online or elsewhere to an audience that includes or may reasonably be expected to include people who are not members of your family or personal friends/acquaintances is forbidden; doing so shall disqualify you from the Program, cancel your referrals, and preclude you from receipt of any benefit or Award under the Program. We may limit participants to receipt of a maximum of ten Referral Awards. A Referral will only result in an Award for a Referree’s first-time Boring mattress purchase, where the mattress was not returned after ninety-nine nights.
4. Rewards: You will receive an Award under the Program for each Referee (subject to Program limits) who buys a Boring mattress directly from the Boring website for the first time, and keeps the mattress for at least ninety-nine nights. Your Referree will also receive a discount on their purchase. Rewards are listed on the referral program page and may change at any time in our sole discretion. If for any reason Boring is unable reasonably to provide the listed reward, we'll provide something that is in our sole discretion of equal value. Awards will be sent to the email account associated with your participation. Awards are non-transferable, non-assignable, and cannot be redeemed or exchanged for cash, credit or any other merchandise outside of the Program.
5. Liability: Boring shall not be responsible for lost, stolen, late, incomplete, altered, or problematic emails, rewards, referrals, or Program materials. Also, Boring shall not be liable if your contact details are incorrect, deleted, or changed. You are solely responsible for any and all tax liabilities associated with your participation in the Program.
6. Privacy: By participating, you agree to us sharing some of your information with those you refer or who refer you, including third parties involved in the Program.
7. Governing Law: This Program is governed exclusively by Arizona law, and any disputes arising from this Program are subject to the Dispute Resolution and Arbitration; Class Action Waiver terms set forth in the Terms of Use.
8. By participating in this Program, you agree to release and hold harmless Boring, its directors, officers, employees, consultants, and agents, and any other entity associated with marketing this Program (collectively, the "Released Parties") from any and all claims or damages arising out of, or in connection with the Program. You further agree that the Program and rewards are provided "as is where is". THERE ARE NO REPRESENTATIONS OR WARRANTIES INCLUDING BUT NOT LIMITED TO STATUTORY WARRANTIES AND CONDITIONS, WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, THIRD PARTIES RIGHTS, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. IN NO EVENT WILL EITHER PARTY BE LIABLE TO THE OTHER FOR ANY CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, EVEN IF ONE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY.
